Defamation is the act of publishing a false statement about someone that damages their reputation. It can be committed in writing, orally, or even visually. To succeed in a defamation claim, the claimant must prove that the statement was false, that it was published to a third party, that it caused them damage and that the defendant intended to cause harm.

Misuse of private information is the unauthorised use of someone's personal information in a way that is highly offensive or distressing. This could include publishing private photos or videos, revealing someone's medical history, or sharing their financial information. To succeed in a misuse of private information claim, the claimant must prove that the information was private, that it was used in a way that was highly offensive or distressing and that the defendant did not have a legitimate reason for using the information.
