Office of the Public Guardian Fee Refund Scheme

Enduring Powers of Attorney and Lasting Powers of Attorney Registered in the period 1st April 2013 to 31st March 2017

Under the above fee refund scheme, a donor or an attorney having registered a Power of Attorney during the above period may be entitled to a refund for the registration fees paid.

Who can make the claim?

You can claim if you are:-

  • the Donor, (the person who made the Power of Attorney); or
  • an Attorney appointed by the Donor in the Lasting Power of Attorney or Enduring Power of Attorney; or
  • an Executor of an estate of a Donor;

AND

  • the application to register the Power of Attorney was made between 1stApril 2013 and 31st March 2017 in England or Wales

Who will the money be returned to?

The money must be paid to the Donor (Donor’s Estate), and it is only necessary to make one claim per Donor even if there was more than one Power of Attorney.

How much will be refunded?

The amount refunded can range between £34 and £54 (plus 0.5% interest) depending on when you paid the fees. If you have paid a reduced fee, then you will only be entitled to half the refund.

What do you need to make a claim?

The donor’s UK bank account number and sort code.

There is no need to know when the fees were paid or to quote any reference when but we would advise having a copy of the registered EPA or LPA to hand.

You MUST claim by telephone if:

  • The donor does not have a UK bank account
  • The donor has died OR you are a court appointed deputy

After you have claimed

It can take up to 12 weeks for your claim to be processed. If your claim is approved, the refund will be paid into the donor’s bank account.

If your claim is rejected you can appeal the decision by contacting the Refunds Helpline on 0300 456 0300.
